Terms of Service

Welcome to the ApiX-Drive Developer Platform ("Platform"). These Terms of Service ("Terms") govern your access to and use of the Platform operated by ApiX-Drive ("Company", "we", "us", or "our"). By accessing or using the Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By registering for an account, accessing, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Platform.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Platform. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Platform Services

The ApiX-Drive Developer Platform provides tools and infrastructure for building, testing, and deploying API integrations. Our services include but are not limited to:

• Visual integration builder with drag-and-drop interface
• AI-powered development assistance (AI Copilot)
• Access to our ecosystem of 1,000+ integrations
• API documentation and development tools
• Marketing support and promotional services for published integrations

5. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
• Interfere with, disrupt, or create an undue burden on the Platform or its infrastructure.
• Attempt to gain unauthorized access to other users' accounts or any part of the Platform.
• Use the Platform to transmit malware, viruses, or other harmful code.
• Reverse engineer, decompile, or disassemble any part of the Platform.
• Scrape, harvest, or collect data from the Platform without prior written consent.
• Use the Platform to build a competing product or service.

6. Intellectual Property

The Platform, including its design, features, content, and technology, is owned by ApiX-Drive and protected by copyright, trademark, and other intellectual property laws. You retain ownership of any integrations and content you create using the Platform. By publishing an integration on our ecosystem, you grant us a non-exclusive, worldwide license to display, promote, and distribute it within the ApiX-Drive network.

7. Your Integrations

• You retain all rights to the integrations you build on the Platform.
• You are solely responsible for the functionality, reliability, and compliance of your integrations.
• Integrations published in Public Mode will be accessible to all ApiX-Drive users.
• Integrations in Private Mode are restricted to your organization and authorized users.
• We reserve the right to remove or disable integrations that violate these Terms or are harmful to users.

8. Data Processing

When your integrations process data through the Platform:

• You are responsible for ensuring compliance with applicable data protection laws (including GDPR, CCPA, and others).
• You must not process personal data beyond what is necessary for your integration's stated purpose.
• You must implement appropriate security measures to protect user data.
• You must promptly notify us if you become aware of any data breach affecting Platform users.

9. Marketing Support

We may provide marketing support for your published integrations, including:

• Listing in our Apps Catalog and creation of a personal landing page.
• Promotional activities across our social media channels and newsletters.
• SEO support including do-follow links and blog articles.
• Video content creation for integration tutorials.

Marketing support is provided at our discretion and may be modified or discontinued at any time.

10. Fees and Payments

The Developer Platform is currently offered during the waitlist and early access period at no charge. We reserve the right to introduce paid plans or features in the future. If we introduce fees, we will provide reasonable advance notice and you will have the option to accept the new terms or discontinue use of the Platform.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
• We do not guarantee uninterrupted, secure, or error-free operation of the Platform.
• In no event shall ApiX-Drive be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform.
• Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless ApiX-Drive and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Platform, your integrations, or your violation of these Terms.

13. Termination

• You may stop using the Platform and close your account at any time.
• We may suspend or terminate your access if you violate these Terms or for any other reason at our sole discretion, with or without notice.
• Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will remain in effect.

14. Modifications to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ApiX-Drive is incorporated, without regard to its conflict of laws provisions. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.
